Terms of Service
These Terms of Service govern your access to and use of the VanTele Mobility platform, including our website, Passenger app and Driver app. By using VanTele Mobility, you agree to these Terms.
1. Acceptance of These Terms
These Terms of Service (the "Terms") form a binding agreement between you and VanTele Mobility (PTY) Ltd, a company incorporated in the Republic of Namibia and a subsidiary of VanTele Holdings (PTY) Ltd ("VanTele", "we", "us" or "our"). By creating an account, accessing or using the VanTele Mobility platform, website or mobile applications (together, the "Platform"), you confirm that you have read, understood and agree to be bound by these Terms.
If you do not agree, you must not use the Platform. We may require you to expressly accept these Terms (for example, by tapping "I agree") in accordance with the Electronic Transactions Act of Namibia.
2. Definitions

| Passenger | A User who requests a Ride, reserves a seat, or sends or receives a Parcel. |
| Driver | An independent driver-partner who provides transport or delivery services through the Platform. |
| Ride | An on-demand city trip booked through the Platform. |
| Trip | A scheduled inter-town journey on which seats may be reserved. |
| Parcel | An item sent for delivery through the Platform, identified by a VTM tracking code. |
| Content | Any text, images, ratings, reviews or other material submitted through the Platform. |
| Fare | The price payable for a Ride, Trip or Parcel, calculated by the Platform. |
3. Nature of the Service — VanTele Is a Technology Platform
VanTele Mobility is a technology platform that connects Passengers with independent Drivers. We are not a transport company, we do not own or operate vehicles, and we are not the employer of any Driver. Drivers are independent contractors who provide transport and delivery services in their own right.
The contract for the actual transport of a person or Parcel is formed directly between the Passenger and the Driver. VanTele facilitates that connection, payment calculation and communication, but is not a party to the transport contract itself.
4. Eligibility and Accounts
- You must be at least 18 years old to create an account and use the Platform. The Platform is not intended for children.
- You must provide accurate, current and complete information and keep it up to date.
- You are responsible for all activity that occurs under your account and for keeping your login credentials and device secure.
- One person may hold only one account unless we agree otherwise. Accounts are personal and may not be transferred.
- We may verify your identity and refuse, suspend or close any account at our reasonable discretion, including where we suspect fraud or unlawful use.
5. Use of the Platform
You agree to use the Platform only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy. You must not misuse, interfere with, or attempt to gain unauthorised access to the Platform or its systems.
6. Bookings, Fares and Payment
- Fares are calculated by the Platform based on factors such as distance, estimated time, town, time of day, demand (surge) and ride type. Estimates are shown before you confirm a booking.
- All amounts are in Namibian Dollars (N$). Fares are rounded to the nearest N$5 for cash convenience.
- You may pay by cash or by digital wallet, where available. Card and mobile-money payments are processed by third-party providers (see clause 9).
- Cancellations, no-shows and refunds are governed by our Refund & Cancellation Policy.
- You are responsible for any government taxes or levies that apply to your use of the service.
7. User Conduct and Safety
You agree to treat Drivers, Passengers and our staff with respect, to comply with all applicable laws, and not to use the Platform to transport or send anything unlawful. Detailed conduct rules appear in the Acceptable Use Policy, and Parcel rules appear in the Parcel Delivery Terms.
8. Driver Verification
We carry out reasonable verification of Drivers before they are activated, which may include checking a Namibian driver's licence, national identity document and police clearance, and confirming vehicle details. Verification does not guarantee the conduct of any Driver, the condition of any vehicle, or the safety of any trip. Users use the service at their own risk.
9. Third-Party Services
The Platform relies on third-party services, including Google Maps Platform (mapping and routing), Flutterwave and MobiPay (payments), Africa's Talking (SMS), Google Play Services (distribution and crash reporting) and our hosting provider. Your use of those services may also be subject to their own terms and privacy policies. VanTele is not responsible for third-party service failures but will use reasonable efforts to select reliable providers. See the Privacy Policy for how these parties handle data.
10. Intellectual Property
The Platform, including its software, design, trade marks, logos and content (excluding User Content), is owned by or licensed to VanTele and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose. You may not copy, modify, reverse-engineer, resell or create derivative works from the Platform without our written permission.
11. User Content
You retain ownership of Content you submit (such as ratings and reviews), but you grant VanTele a worldwide, royalty-free licence to use, store and display that Content for the purpose of operating and improving the Platform. You are responsible for your Content and must not submit anything unlawful, defamatory or that infringes another person's rights.
12. Disclaimers and Limitation of Liability
To the maximum extent permitted by Namibian law:
- The Platform is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or that estimates (including fares and arrival times) will be accurate.
- VanTele is not liable for accidents, injury, death, loss, theft, delay, or damage arising from a Ride, Trip or Parcel, beyond what the law requires, and beyond any stated Parcel cover in the Parcel Delivery Terms.
- VanTele is not liable for failures of third-party services, or for events beyond our reasonable control, including load shedding, network or power outages, severe weather, natural events, civil disruption and other force majeure events.
- Where liability cannot lawfully be excluded, our total aggregate liability to you for any claim is limited to the value of the specific transaction giving rise to the claim.
13. Indemnity
You agree to indemnify and hold VanTele harmless against claims, losses and reasonable costs arising from your breach of these Terms, your misuse of the Platform, or your own unlawful or negligent conduct.
14. Disputes Between Users
Disputes between a Passenger and a Driver (for example about a Fare, route or Parcel condition) are primarily a matter between those Users. VanTele provides a support and resolution process and may investigate and take action under our policies, but VanTele is not the final arbiter of fault and does not guarantee any particular outcome.
15. Suspension and Termination
You may stop using the Platform at any time and request closure of your account. We may suspend or terminate your access where you breach these Terms, where required by law, or to protect Users or the Platform. We do not delete transaction records that we are required to retain; we change account status instead (see the Privacy Policy on retention).
16. Changes to These Terms
We may update these Terms from time to time. Where changes are material, we will give reasonable notice through the Platform, by email or by SMS before they take effect. By continuing to use the Platform after the effective date of an update, you accept the revised Terms.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Namibia. You agree that the courts of Namibia have jurisdiction over any dispute arising from these Terms or your use of the Platform.
